都計法與建築法專題研究

一． 課程內容

本課程每年僅開設一學期課程，所以本學期之討論主題將不再區隔成上學期─都市計畫法；下學期─建築法，而將混合成「公部門建設法」大標題下，予以綜合性討論。本學期擬討論之議題主要以「國土計劃法」草案為中心，其子題尚有：

1. 國土空間管制綜合法令體系及其矛盾
2. 特別之國土規制法：文資法、水保法、國家公園法等
3. 都市土地管制常見之判決紛爭分類
4. 非都市土地管制常見判決紛爭分類
5. 國土計劃法草案總檢討
6. 外國國土計劃法：主要內容
7. 國土計劃法與行政計畫法
8. 國土規劃與建築管理


二． 評分標準

選課同學必須選擇一個子題作為課堂報告內容，其上課出席率、發言程度及
期末書面報告將成為評分之主要依據，在得授課教師允許下，亦得選擇其他相關議題，自訂題目報告。

The Seminar on Administrative Law

Professor Ming-Chiang Lin

In this semester, we will conduct collaboration works, discussing the administrative law based upon this unique background. So as to expend the views of the students and to enhance their ability to apply law in proper way.. Possible topics include administrative juristic persons, administrative measure, administrative execution, administrative litigation.
Specific issues of discussion will be further finalized when the semester starts. We will discuss the scope of our works in the first week of the semester.
Participants will be required to do extensive written works. Participants need to prepare submissions on a regular basis and to actively engage in class-discussions.
During our discussions, we will conduct detail analysis of the administrative law to enable the students to secure their understanding the core principle of the administrative law.
